The Customer – an entity purchasing products and services for his own use or for further distribution using the services offered by the online store.

The online store available at https://filetoprint.waw.pl address is the FILE TO PRINT company service, through which the Customer can sent the orders.

The order – the Customer declaration of the will, seeking directly to conclude the sales agreement, which indicate the type and quantity of the goods.

Terms and conditions – these terms of electronically supplied services within the framework of the filetoprint.waw.pl website / online store.

Products – final products, which include materials necessary to preparation of jobs and printing services traded within the filetoprint.waw.pl website / online store.

Purchasing process – process which is started at the selection of a product, through parameters definition, until to sent the order.

Sales agreement – contract concluded between the company FILE TO PRINT Tomasz Siniak and the Customer using the filetoprint.waw.pl website / online store, which is at the same time a contract for the sale of products in the understanding of the Civil Code.

III. Rules for using the filetoprint.waw.pl website / online store

Products in the store can be placed in the Cart without registering a user account. The Cart is a temporary storage of products. You can opt out of purchasing a product in the Cart by clicking the “X” button next to the previously selected product.

To creation a user account, you must complete the registration form correctly. User account registration is available for customers who plan in future to shop again at filetoprint.waw.pl website / online store. Registration of the user account in the filetoprint.waw.pl website / online store means consent to the content of the Regulations.

Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

The Customer of the FILE TO PRINT company / filetoprint.waw.pl website / online store can be legal persons, organizational units without legal personality, to whom separate provisions give the right to acquire rights and incur obligations, as well as natural persons conducting business or professional activity. The Customer of the FILE TO PRINT company / filetoprint.waw.pl website / online store can be also a natural person who does not run a business or professional activity.

The FILE TO PRINT company may restrict access to part or all of the filetoprint.waw.pl website / online store’s resources with immediate effect in the event of customer breach of the terms and conditions, in particular if:
(a). The Customer provided inaccurate, outdated or untrue data during registration by misleading or infringing the rights of third parties,
(b). The Customer has breached the personal interests of third parties through an online store,
(c). The Customer has committed behaviors that will be considered by the FILE TO PRINT company to be contrary to applicable laws or internet users, as well as in situations that undermine the good name, opinion of the FILE TO PRINT company.

The Customer of the filetoprint.waw.pl website / online store can not:
(a). provide and transmit materials and content contrary to the provisions of applicable law,
(b). use the filetoprint.waw.pl website / online store in a way that interferes with its operation,
(c). distribute unsolicited commercial information (spam) within the filetoprint.waw.pl website / online store,
(d). use the filetoprint.waw.pl website / online store in a way that is difficult for other users of the service and for the FILE TO PRINT company itself.

The Customer undertakes to use the content posted on the filetoprint.waw.pl website / online store as part of their own use.

The Customer undertakes to use the filetoprint.waw.pl website / online store in accordance with the laws, as well as the terms of filetoprint.waw.pl website / online store and the generally accepted rules of use of the Internet web.

Using the filetoprint.waw.pl website / online store means accepting the above terms and conditions and reviewing the Privacy Policy of the FILE TO PRINT company, available on the website.


IV. Conclusion of the sales agreement

During the purchasing process the Customer selects the product and determines its specifications, which is the subject of the purchase agreement.

The conclusion of the sales agreement is made via the website / online store located at the address filetoprint.waw.pl, as well as by submitting an order using a form located on the Contact page or sending an order via email: info(at)filetoprint.waw.pl

This is equivalent to the fact that the Customer has selected the product and its specifications, took steps based on the displayed messages and sent the order.

The Customer selects the payment method and also provides file delivery data or delivery address that the shipment has to be sent with the order.

During the 3 first orders, we favour a advance payment with a value to be agreed (standard about 50%-100%), based on invoice, proforma invoice (the natural persons provide data without tax identification number, NIP number, name, surname, address), PayPal payments, direct bank transfers, cash prepayment.

Once the order, it is necessary that the Customer has specify selected product, sent all the materials, as well as defined the target parameters necessary to complete the job.

Clicking a “PLACE ORDER” button will generate an email message that will be sent to the provided email address. The message is a proposal to conclude a sales agreement and summarizes the entire order, i.e.: order item, total price of the order, payment method, delivery address / file delivery data.

The order starts after:
(a). customer has sent all the materials, as well as defined the target parameters necessary to complete the job.
(b). payments receipt (unless we determine the other rules of cooperation)

Submission the materials and the data’s for the execution of the order by Customer, constitutes a declaration of intent to conclude a sales agreement with the FILE TO PRINT company.

A Paid orders results their transfer to execution and prevents the resignation.
The order accepted for execution will be confirmed by email.
Payment for the order is possible before approval of job.

Due date of the order performance is approximate and it is determined by its complexity, as well as the time of delivery of both materials and parameters/information by customer.

In case of commencement of cooperation per hours – standard advance payment (about 30-50%) and the first 3 payments on the day of transferring the final production files to you / VAT invoice (to be agreed).

Payment per hours for selected services is possible by:
(a). using the filetoprint.waw.pl website / online store with the choice of payment method,
(b). for the orders placed via Contact form or email, before start of the order, with the choice of payment method.

The Customer may cancel the paid order by wire transfer only until the files are approved.

Orders are accepted at 24 hours a day, 7 days a week. The standard working hours of the FILE TO PRINT company are specified on the service page (footer widget).

The FILE TO PRINT company has the right to withdraw from the sales agreement, withdraw the order and a payment to the Customer, if it has occurred sales of an item containing an error in price or in parameters, even if the purchase has been intentionally or inadvertently, same when the provided data was incorrect or when there is no contact with the Customer.

The services do not include:
– making photos of products, creating logotypes, drawing complex vector forms (e.g. figures, illustrations, pictograms, symbols, maps), costs of stock photos, vectors etc., costs of rubber, automatic stamps, CIP3 files, printing plates preparation.

All prices are net prices, and they do not include costs of delivery / shipping. If you would like to buy our products with shipping to different postal addresses, please send us the separate orders.

Method of reception:
– foreign courier shipment, local and domestic (in Poland) courier shipment surcharge for the service,
– free self reception in Warsaw of Poland (to be agreed).


V. Processing of personal data

The user of the filetoprint.waw.pl website / online store declares that consent to the processing by the FILE TO PRINT company a personal data, introduced by himself on the website / online store and entrusting their processing to the service provider of the store software, as well as the provider of hosting services.

The FILE TO PRINT company will collect and store data only for the execution of orders made by the Customer.

The data is collected only for the purposes of fulfilling orders and in situations necessary for the correct completion of the order:
(a). the execution of the contract using a graphic design provided by the Customer,
(b). the execution of the order from materials provided by the Customer,
(c). contact with the Customer by electronically via i.e. email for the correct performance of the order,
(d). delivery of the order – sharing the address details of the courier company, in order to deliver the order.

Data processing is necessary to perform a contract with the Data Subject.
The store software provider processes personal data only for the proper functioning of the software and may not use personal data.

Regulation only when using ftp services. The hosting service provider stores graphic design files submitted by filetoprint.waw.pl website / online store customers only for the purpose of properly finalizing the order and recreating the order history. Project files can be deleted at any time by the Data Controller. The FILE TO PRINT company shall not be held responsible for deleting files and possible consequences.

At the Customer request sent to the email address: info(at)filetoprint.waw.pl any personal data except financial documents / files, will be deleted from the FILE TO PRINT’S company’s databases and the Customer will be informed about this in a return message.

The data will be stored until the Customer submits a request to the email address: info(at)filetoprint.waw.pl to delete them from the FILE TO PRINT company’s databases.

In the case of a written request, the FILE TO PRINT company may change a Customer’s data in company’s database. About data’s changes the Customer will be informed by electronic means.

The filetoprint.waw.pl website / online store encrypts data using an SSL certificate.

Scope of the data processed: company name, name of the contracting entity, name and surname, TAX ID (VAT number), contact telephone, correspondence / mail address, order delivery address, email address, order files.

A promotional information called “newsletter” may be sent to the Customer’s email address only if the Customer early agrees to their sent.
On request sent to the email address: info(at)filetoprint.waw.pl, the commercial correspondence will be completed.


VI. Products Delivery

The Customer is obliged to familiarize himself with the presented delivery date. The FILE TO PRINT company allows situations of non-timely execution of the order due to independent reasons, such as i.e. electricity supply interruptions, Internet signal break, technical problems resulting from equipment failure or the need to them repair, maintenance, as well as by the reasons from others, suppliers, courier companies etc.

The FILE TO PRINT company shall not be held responsible to Customer for independent reasons.

The delivery of ordered products is carried out electronically or to the mail postal address indicated by the Customer when placing the Order, by e-mail, ftp server, downloadable link (e.g. Wetransfer) etc. or courier supplier companies.

The order delivery shall be carried out as were indicated by the Customer in the Orders form.


VII. Prices and delivery method

The prices of presented products on the filetoprint.waw.pl website / online store are expressed in EURO currency, and they do not include 23% VAT tax, cost of delivery/shipping. The prices included: order service cost, product cost, electronic shipment graphic design files.

The services and prices do not include:
– making photos of products, creating logotypes, drawing complex vector forms (e.g. figures, illustrations, pictograms, symbols, maps), costs of stock photos, vectors etc., CIP3 files, printing plates preparation, custom taxes, cost of hot stamping mould preparation, cost of additional custom delivery options, such as i.e.: foreign, local, domestic (in Poland) shipping, delivery, shipping surcharges to multiple mail postal addresses, shipping abroad.

Payments for the orders may can by realized via:
(a). cash in Warsaw of Poland, nevermind which currency PLN, EUR, GBP, USD, CHF, other,
(b). PayPal and other similar services,
(c). direct bank transfer,
(d). choosed payment methods of the orders send via our store.

Upon express request, the Customer may receive a PRO-FORMA invoice for prepayment or advance payment for products or services ordered outside the filetoprint.waw.pl website / online store.

Personal data of the customers making payments through PayPal are collected by: PayPal (Europe) S.à r.l.et Cie, S.C.A. (R.C.S. Luxembourg B 118 349), under the supervision of the Luxembourg Financial Supervision Commission (Commission de Surveillance du Secteur Financier, CSSF).

When the Customer sent us the order, agrees to:
(a). attach a invoice / VAT invoice to the order and the shipment,
(b). receive invoices and credit notes electronically makes.


VIII. Files, materials for print preparation, processing, printing, approval etc.

The FILE TO PRINT company shall not be held responsible for copyright infringement and the content of the materials sent by the Customer.

If the Customer receive materials or projects that contain illegal content, the FILE TO PRINT company may refuse to execute the Order.

The FILE TO PRINT company shall not be held responsible for the substantive errors contained in the graphic design sent by the Customer for further implementation, e.g. in the case of a graphic design sent to preparation montage or imposition.

How to prepare and deliver projects and materials for further job?

For each job, please define separately the target parameters or the types of alterations, in terms of the printing technique.

How to send us files above 10 Megabytes via WeTransfer?
To upload us the files above 10 Megabytes, you can use the WeTransfer service, which allows free transfer up to 2 Gigabytes. Go to the https://wetransfer.com website, select “Add your files” or “Or select a folder”, add files, in the “Email to” field please type the recipient’s email, such as e-mail: info(at)filetoprint.waw.pl in the “Your email” field type your email, you can also add a short message, then press the “Transfer” button. Next you must to Verify your email. In the “Enter verification code” field, please type the code that you’ll receive from the WeTransfer service to your (sender’s) email address, and then press to “Verify” button. When the upload is complete, the sender should receive an automatic message from the WeTransfer service. Recipient should receive the message with the link that was shared to download. Note! Shared links are active only for 7 days.


How to prepare files for Fogra certified proofs, press proofs, printer’s proofs, colour accurate proofs, contract proofs prints?

Jobs to Fogra certified proofs printouts – should be sent as composite PDF files, TIFF files prepared for printing as a attachments (to the 10 MB) or link eg. Wetransfer to download to the written orders via email.

Jobs should be prepared in CMYK colour space. If the job contains spot colours, cutting die, varnishing masks etc. – these components have to be precisely indicated (marked).

Prefered files to print without embedded color profiles, included varnishing masks, cutting dies, perforations, crease’s, if they doesn’t have to be printed on contract color proof.

If the reference profile must be different than our default ISO Coated V2 (ECI), please indicate type of reference profile to the Fogra certified proofs (press proofs, printer’s proofs, contract proofs prints). Please also indicate information about Ugra Fogra control strip, if must be or not included.

If you want have a coloured mirror margins to wrap on the frame you need to send a 5 cm size on each side larger photo than frame is. If you can’t prepare this, we can add the frame margin by ourself.

If the graphic design, artwork or photo is prepared on bleed, has a full-colored background, must be framed without white margins – bleed dimensions for framed canvas paintings, photos, other prints 5 cm size on each side, bleed dimensions for trimmed paintings, photos, other prints in frames 5 mm size on each side, 350 dpi resolution, flattened artwork without layers, LZW compression or packaged ZIP, project centred on the page, distance of graphic objects and texts from the cutting lines (trim size) minimum 3 mm, cutting lines in project behind the bleed box, fonts converted to curves / outlines.


How to prepare files for photo prints, fine art prints?

Photo files to to printing, fine art prints files for production should be sent high quality, accepted PNG, JPG, TIFF, PSD Adobe (PC) software files or PDF files.

The FILE TO PRINT company shall not be held responsible for potential colour differences resulting from converting colour spaces other than CMYK colour space, as well as from converting spot colours (PANTONE, HKS etc.) to CMYK colour space.

Before approving the job, Customer shall receive a preview file in order to check its correctness, in particular the contact details, and to verify the entire content of the job. After having done so, customer shall send a written approval to an email: info(at)filetoprint.waw.pl

Each graphic project includes 3 free of charge corrections (not applicable to creation of graphic design from the begining). These corrections include e.g. alteration of objects orientation, objects modification, colour changes, text edition, font changes, graphic changes etc.

Approval is necessary rule to send production file to Customer.
No complaints regarding the content shall be considered after the approval of a job.
Customer receives the approved job in PDF file format (to be agreed), which is prepared to exposure or printing.

The FILE TO PRINT company shall not be held responsible for the delivery by Customer files incorrectly prepared for printing, as well as for delays in the execution of the orders resulting from the Customer’s failure to provide the graphic designs or to provide a bad prepared graphic designs.

Data stored in the FILE TO PRINT company is indefinitely, the company is not obliged to archive Customer’s files.


IX. Complaints

The basic condition for approval the complaint is to sent an email notification, at email: info(at)filetoprint.waw.pl

The complaint must include a description of the incompatibility and complaint request.

The deadline for complaint processing is 14th business day from the date of delivery to the Customer / reception the order by the Customer.

The FILE TO PRINT company will process complaints within 3 business days from the moment of filing.

In order to complete the complaint procedure, the FILE TO PRINT company may request the Customer to send / provide the order files and to indicate all necessary information.

After receiving an email message from the FILE TO PRINT company of such a nature – the Customer is obliged to provide the above within 7 working days of receiving the email message, otherwise the complaint procedure will be completed, the complaint will be rejected.

For the technological reasons resulting from differences between the way which RGB computer screen’s display colors – and CMYK printing technology, the color compatibility on printouts with the images presented on the screen – may not be the reason for complaints.

Due to the use in production processes a various printing machines – the color differences in mapping certain colors when resuming a draft for printing cannot be the basis for product complaints.

The complaint of the status of courier shipments delivered to the Customer will be considered on the basis of the damage protocol made upon the delivery of the shipment. Failure to protocol of injury may result in a refusal to take into account the complaint.

The FILE TO PRINT company shall not be held responsible for third parties’ activities, delays in the posting of payment funds, delays in the supply of products, resulting by the suppliers, courier companies activities etc.
